1. Agreement
By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) and capable of forming a binding contract. You may not use the Services if you are barred under applicable law or if we have previously suspended your account for violation of these Terms or our policies.
3. The Services
NagarPulse provides community tools for Bangladesh, including but not limited to:
- Civic reporting with photo, video, and location data, public maps, and report timelines.
- Community verification through reactions, comments, and moderation.
- Optional emergency alerts to nearby volunteers who have opted in.
- Volunteer response tools and RouteBuddy commute matching for verified users.
- Public transparency pages for authorities and area statistics where data is available.
4. Accounts and authentication
You are responsible for your account. You agree to:
- Provide accurate registration information and keep it up to date.
- Maintain the confidentiality of your credentials and notify us of unauthorised access.
- Accept responsibility for activity under your account unless you report compromise promptly.
- Not create multiple accounts to evade enforcement or manipulate community signals.
5. User content and licence
You retain ownership of content you submit. By posting content to the Services, you grant NagarPulse a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that content as necessary to operate the Services, including on public maps and track pages for content you mark as public. You represent that you have the rights to submit the content and that it does not violate third-party rights or applicable law.
6. Prohibited conduct
You may not use the Services to:
- Violate our Community Guidelines, Safety Policy, or applicable law.
- Submit false, fraudulent, or deliberately misleading reports or emergency alerts.
- Harass, threaten, dox, or endanger any person.
- Upload malware, scrape or disrupt the Services, or attempt unauthorised access.
- Impersonate another person, organisation, or government entity.
- Collect personal data from users without consent or use the Services for unsolicited commercial messaging.
7. Moderation
We may review, remove, restrict, or annotate content and suspend accounts at our discretion to enforce these Terms and protect users. We are not obligated to monitor all content but may do so. Moderation decisions are not subject to appeal in all cases but you may contact us with concerns.
8. Third-party services
Sign-in through Google, Facebook, or Apple and other third-party integrations are subject to those providers' terms. RouteBuddy payments occur directly between users; NagarPulse is not a payment processor or transport provider. We do not guarantee the conduct of volunteers, other users, or third-party services.
9. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law:
- NagarPulse is an independent community platform, not a government agency or official emergency dispatch service.
- Civic reports reflect community submissions and may not be verified by authorities.
- Emergency and volunteer features do not guarantee response, outcome, or safety.
- RouteBuddy is not a licensed ride-hailing or public transport service.
- We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by applicable law, NagarPulse and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services shall not exceed the greater of (a) amounts you paid us in the twelve months preceding the claim, or (b) one hundred United States dollars (USD 100), except where liability cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless NagarPulse and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, your violation of these Terms, or your violation of any third-party rights.
12. Termination
You may stop using the Services at any time and may request account deletion as described in our Account Deletion page. We may suspend or terminate your access immediately for violation of these Terms, legal requirements, or risk to users or the platform. Provisions that by nature should survive termination (including licences granted for previously public content, disclaimers, limitation of liability, and indemnity) will survive.
13. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise. Disputes shall be subject to the exclusive jurisdiction of the courts of Bangladesh unless applicable law requires otherwise.
14. Changes
We may modify these Terms from time to time. We will post the updated Terms with a revised date. Material changes may be communicated through the app or website where practicable. Continued use after changes become effective constitutes acceptance where permitted by law.
